1. Preface

The following institutions CNRS, INRIA, UJF and INPG hold all the property rights on ProBT software, version 1.1 of june 1st 200X. The commercial and industrial exploitation of this software was conceded in an exclusive way to the Probayes Company.

The Probayes Company give its agreement to GRAVIR laboratory for the free distribution of the object code of the ProBT library to the scientific community so that it can be used for research and educational purposes.

The aim of this license is to lay down the conditions enabling you to use the ProBT software. However, CNRS, INRIA, UJF and INPG remain the authors of the ProBT software and so retain the enjoy and the use of all ancillary rights.

The rights granted to the users by the present license are given only for experimentation, evaluation, research and education purposes.

Any activity, for commercial or industrial purposes or on the production lines of the licensee, realized from the ProBT software or ProBT derived software or from composite software integrating all or part of the ProBT software would constitute an infringement of copyright.

2. Definitions

The SOFTWARE term indicates the object code of the software ProBT in the form of library, the source of the headings of functions available in the library as well as the technical documentation. The source code of the software version X.X of june, 1st 200X is registered at the Agency or the Protection of Programs (APP: 119, avenue de Flandre 75019 Paris - France) and its technical documentation.

ProBT COMPOSITE SOFTWARE is defined as all or a part of the SOFTWARE that you have interfaced with software, an application package or a toolbox of which you are owner or entitled beneficiary.

3. Object and conditions of the SOFTWARE license

1. You are authorized to reproduce the SOFTWARE on any present and future support.
2. All new user of the SOFTWARE is obliged to obtain the software from the GRAVIR laboratory and to sign the present license.
3. All distribution of the SOFTWARE is forbidden.

4. Object and conditions of the license concerning COMPOSITE SOFTWARE

1. You are authorized to interface all or part of the SOFTWARE with all or part of other software, application packages or toolboxes of which you are owner or entitled beneficiary in order to obtain COMPOSITE SOFTWARE. The resulting COMPOSITE SOFTWARE is restricted for experimentation, evaluation, research and education purposes. The use of the COMPOSITE SOFTWARE for commercial or industrial purposes or on the production lines of the licensee, would constitute an infringement of copyright. The following reference should be prominently mentioned: «composite software using ProBT functionality © CNRS»;
2. Any distribution of COMPOSITE SOFTWARE shall have been previously authorized by the GRAVIR laboratory and is subjected to the signature of this license.

5. Limitation of the guarantee

The SOFTWARE is supplied as is, with no explicit or implicit guarantee, including guarantees adaptation. You assume all risks concerning the quality or the effects of the SOFTWARE and its use. If the SOFTWARE is defective, you will bear the costs of all required services, corrections or repairs.

6. Consent

When you access and use the SOFTWARE, you are presumed to be aware of and to have accepted all the rights and obligations of the present license.

7. Binding effect

This license has the binding value of a contract.

8. Language of the contract - Enforceable Law - Competent court

The present license is drawn up in French version and in English version; in case of dispute, the French version shall be deemed authentic.

The present license and its effects are subject to French law and the competent French courts.
